Retirement benefit. For who?
According to art. 92. From the Labor Code, every employee is entitled to a retirement allowance – regardless of the employment relationship entered into or the length of employment with the last employer. To qualify, it is not enough to reach retirement age. You should actually retire and leave a paid job.
You can only receive a check-in once – it cannot be received by people who have already collected it. It is important to note that several severance benefits may be received if we work for more than one employer. However, you have to withdraw everywhere at the same time. Information on the acceptance of severance pay should be included in the certificate of employment. The retirement indemnity is not granted to people who have until now carried out work on the basis of a mandate contract or a specific assignment contract.
Retirement benefit. How much costs?
As a general rule, the retirement indemnity is equal to the monthly salary. However, there are exceptions to this rule – the employer can include a higher amount in the compensation settlement. In addition, some professional groups can count on a larger amount – for example, teachers. They can count on a severance pay in the amount of:
- a salary of two months – if he worked less than 20 years,
- three months’ salary – if he has more than 20 years of professional experience.
Local government employees can also receive more at the end of their work. The amount of severance pay then depends on seniority:
- for more than 10 years of service, the bond is equal to the amount of two months’ salary
- with professional experience of more than 15 years, the bond is equal to the amount of three months’ salary
- for more than 20 years, the severance pay has been equal to six months’ salary.
After 40 years of working in local government, the severance pay is a Jubilee award. Such a retirement allowance is available for employees of state offices, local government, civil service, budget sphere, teachers, miners and some employees of public universities.
