The Sejm adopted the Lex Czarnek 2.0 on Thursday. The deputies rejected the objection of the Senate, which considered that the new regulations violated the right of parents to raise their children in accordance with its principles. The bill will now go to the president’s office. 444 people took part in the vote on the amendment to the Education Act deputies. 224 deputies voted for the rejection of the objection of the Senate, 218 were against and 2 abstained from voting.
Previously, the amendment to the Education Law was rejected by the Senate. The Senate Local Government and State Administration and Science, Education and Sports Committees have issued negative comments on the new regulations. In order for the Lex Czarnek 2.0 to be forwarded to the President, the Sejm had to reject the Senate’s resolution to reject the amendment to the law by an absolute majority of votes in the presence of at least half of the statutory number of deputies. Lex Czarnek 2.0 act approved by the Sejm
Lex Czarnek 2.0, a parliamentary project presented by a group of law and justice deputies, assumes that for school associations and other organizations that are not political parties are functioning, it will be necessary to go through a complex procedure. According to the Ministry of Science and Education, in the vast majority of cases there will be no problems.
According to the amendment, in order for a body to enter a school and provide lessons to pupils, the school or school council or the parents’ council must issue an opinion on the body. Before this happens, these councils should consult with the parents, after having informed them of the activities of the organization, the objectives and the content of the planned project and familiarize themselves with the lesson scenarios that the organization has l intent to conduct and equipment provided by the organization to the headteacher. The law does not specify the mode of conduct of the consultations, this is to be defined by the council itself in the regulations of its activity. It is only after consultation that the council can issue an opinion.
The project also provides for new rules for homeschooling, including zoning the process, introducing a 50% limit on the number of students using this solution in a given establishment and reducing the time allowed to three weeks. parents to apply for home schooling. During the work of the parliamentary committee, deputy candidate Tomasz Zieliński presented several amendments, relaxing the initial proposals, including extending the application period for home schooling – from July 1 to September 21.
According to the opposition, which criticizes the PiS project, by duplicating many solutions of the law which the president vetoed, March this proposal is Lex Czarnek 2.0. Politicians from the Civic Coalition and representatives of non-governmental organizations felt that this was an attempt to politicize the educational process by strengthening the position of the superintendent of education, i.e. the office whose appointment is decided by the head of the Ministry of Education and Science. On the other hand, deputies of the Confederation, as well as representatives of the third sector, pointed out – in their opinion – negative solutions leading to limiting and hindering home schooling. All opposition amendments were voted down.
